Starting today, Mininova will use a content recognition system that detects and removes torrent files linking to copyright infringing files. The system will also prevent the torrents from being re-uploaded to mininova later on. Mininova co-founder Niek told TorrentFreak that the system will be tested for 12 weeks with only a few titles. With this trial Mininova collaborates with an association representing several TV/movie content owners. Niek couldn’t tell us which one, but our best guess would be that it’s the MPA(A). The content removal system should be seen as an extension of the existing copyright policy according to Niek, who also said that the current trial will be used to find out whether the content recognition system is a workable and effective solution.

One of the four men convicted in The Pirate Bay trial is seeking to have his guilty verdict thrown out after learning that the judge in the trial is a member of two pro-copyright groups, including one whose membership  includes entertainment industry representatives who argued in the case. Stockholm district court judge, Tomas Norström told a Swedish newspaper that his previously-undisclosed entanglements with the copyright groups did not constitute a conflict of interest. The groups include the Swedish Association of Copyright, a discussion forum. Henrik Pontén of the Swedish Anti-Piracy Bureau, Monique Wadsted, a motion picture industry lawyer, and Peter Danowsky from the recording industry's IFPI are members of the  organizations, and were largely responsible for pressing the case against The Pirate Bay before the judge. Norström also sits on the board of the Swedish Association for the Protection of Industrial Property, and the Internet Infrastructure Foundation, which oversees the dot-se country code and advises on domain name disputes. Monique Wadsted is one of his colleagues at the foundation. The judge's links to the groups were reported by Swedish National Radio.

It’s has been a good week for the entertainment industry lobbyists. Hundreds of news outlets wrote in detail about how the RIAA and MPAA are negotiating with Internet service providers to warn alleged copyright infringers. No one seemed to notice that this isn’t really news as they’ve been working together for years, with ISPs passing on warnings to their customers on behalf of the studios.

As the entertainment industries turn their lobbying power towards ISPs and governments in their on-going battle against file-sharers, more and more people are looking at neutralizing the effects of monitoring and new legislation. Many file-sharers already pay a few dollars each month for a VPN service. This type of facility allows the user to protect his Internet connection with encryption while “tunneling’ data in privacy through the servers of a VPN provider, usually located in another country. The user’s ISP-designated IP address remains hidden, revealing only a second IP address provided by his VPN company. This type of service hinders outsiders from finding the identity of an individual behind an IP address, while helping Internet users effectively side-step laws which may prove inconvenient or unpalatable in their home country. For those who like to share files, one country set to introduce an extremely unpalatable law is Sweden. Due to come into force in just over a week, the controversial Intellectual Property Rights Enforcement Directive (IPRED) legislation will make it easier for copyright holders to get their hands on the personal details of suspected illicit file-sharers. But not if the crew of The Pirate Bay have anything to do with it. Timed to coincide with the introduction of IPRED on April 1st 2009, a brand new service designed to neutralize the effects of the law will be launched. Dubbed ‘IPREDATOR’, this brand new anonymity service from The Pirate Bay promises to make subscribers “more anonymous” than when using traditional VPN services.

Die erste Woche im Prozess gegen die Betreiber von "The Pirate Bay" ist vorbei und die Piraten jubeln: Zuerst musste die Anklage ihren Hauptvorwurf “Mittäterschaft bei der Vervielfältigung” urheberrechtlich geschützten Materials" fallen lassen. Nachher stellte sich mehr und mehr heraus, dass sie große Probleme hat den Angeklagten konkrte strafrechtlich Relevante Handlungen nachzuweisen. The music industry should embrace the Internet instead of fighting it, according to the minister. “All previous technology advances have led to fears that the older format would die. But TV did not kill radio, the Web did not kill the book, and the download is not going to kill music,” Solhjell wrote. The music industry fears new technologies according to Norway’s Minister of Education. He believes that if radio had been invented today the record labels would have tried to shut that down too. “But just as the radio and cassettes haven’t killed music, it is a preposterous claim to say that file-sharing does,” Solhjell told VG nett.

Im Prozess gegen die Betreiber von "The Pirate Bay" gab es gestern eine Überraschende Wende. Staatsanwalt Håkan Roswall musste den schwerwiegenden Vorwurf fallen lassen. Roswall wirft den vier Angeklagten nun nicht mehr die "Mittäterschaft bei der Vervielfältigung" urheberrechtlich geschützten Materials vor. Dem britischen Online-Dienst The Register zufolge musste Staatsanwalt Roswall seine Klageschrift zurechtstutzen, weil er am ersten Prozesstag nicht beweisen konnte, dass seine als Beweismaterial gesammelten Beispiel-Downloads durch den Pirate-Bay-Tracker ermöglicht wurden.

Der Prozess gegen die Internet-Tauschplattform "The Pirate Bay" in Stockholm hat nach Ansicht des Chaos Computer Clubs (CCC) übergeordnete Bedeutung für die Frage, wie zukünftig mit Inhalten im Netz umgegangen wird. Das für Anfang März erwartete Urteil des schwedischen Gerichts zeichne "den Weg in der Zukunft (…) vor", sagte Michael Horn vom CCC.

Am Montag beginnt in Schweden der lang angekündigte Prozess gegen The Pirate Bay. Janko Roettgers hat viele Informationen rund um den Prozess in einem Artikel zusammengetragen: The Definitive Primer to the Pirate Bay Trial.

What happens if the Pirate Bay has to shut down? The Bay’s admins have promised to have back-up plans in place, but even a temporary interruption could lead to a domino effect that could knock out some other sites because of increased traffic. Torrentfreak reported this weekhosts many other BitTorrent sites. that some even expect a “BitTorrent meltdown” due to the wide reliance on the Bay’s tracker servers. That may be a little overstated, but there would definitely be some collateral damage — if for no other reason that the fact that the Pirate Bay’s owners also operate an ISP that So what now? The case is scheduled to last until March 4th, with major depositions being held over the next few days. An audio feed of the court proceedings will be streamed live in Swedish, and there are also rumors about a live-translated English audio stream. The Pirate Bay and its supporters have started a special site to publish continuous updates, and have begun to recruit Twitter users to help with translations and similar tasks. Of course, we will follow and report on major developments in the case as well.
